Welcome to TryFluentia ("TryFluentia", "the Application", "we", "our", or "us").
These Terms of Use ("Terms") govern your access to and use of the TryFluentia desktop application and related services.
TryFluentia is an AI-powered language learning application designed to help users learn languages through publicly available online video content, local speech recognition, and AI-assisted learning features.
By downloading, installing, accessing, or using TryFluentia, you agree to these Terms.
If you do not agree with these Terms, please do not use TryFluentia.
1. Description of Service
TryFluentia provides AI-assisted language learning tools, including:
- Learning from online video content
- Local speech recognition
- Real-time transcript generation
- Vocabulary learning
- Knowledge cards
- AI-powered explanations
- Grammar analysis
- Cultural context explanations
- Personalized learning assistance
TryFluentia is designed as a learning assistant and does not replace professional language instruction.
We may modify, improve, suspend, or discontinue features of the Application at any time.
2. Supported Platforms
TryFluentia currently supports:
- Windows 10
- Windows 11
Future versions may support additional platforms.
3. Account Registration
Certain features require an account.
TryFluentia supports account authentication through third-party providers, including:
- Google OAuth 2.0
- GitHub OAuth
When creating an account, you agree to:
- Provide accurate information.
- Maintain the security of your account.
- Notify us of unauthorized account access.
You are responsible for activity performed through your account.
TryFluentia does not store your Google or GitHub passwords.
4. Software License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to use TryFluentia for personal language learning purposes.
You may not:
- Copy, modify, distribute, or sell the Application.
- Reverse engineer, decompile, or attempt to extract source code except where permitted by applicable law.
- Remove copyright or ownership notices.
- Use the Application to provide unauthorized resale or competing services.
- Circumvent security mechanisms or usage restrictions.
All rights not expressly granted remain reserved.
5. Local Data and User Responsibility
TryFluentia uses a local-first architecture.
The following data is stored locally on your device:
- Learning history
- Vocabulary records
- Knowledge cards
- Learning notes
- AI-generated study materials
- ASR transcripts
- Personalized learning information
TryFluentia does not maintain a cloud copy of your local learning database.
You are responsible for:
- Protecting your device.
- Maintaining backups of local data.
- Managing access to your computer.
We are not responsible for loss of local data caused by device failure, operating system issues, accidental deletion, or user actions.
6. System Audio Capture and Third-Party Content
TryFluentia enables language learning from publicly available online video content.
To provide learning features, TryFluentia may capture system audio output from your computer.
System audio may include:
- Audio from online videos.
- Educational content played by the user.
- Other audio sources selected by the user.
Important:
- TryFluentia does not access microphone input.
- TryFluentia does not record your voice.
- TryFluentia does not capture private conversations.
- Audio processing is performed locally on your device.
Users are responsible for ensuring that their use of third-party content complies with:
- Copyright laws.
- Platform terms of service.
- Applicable regulations.
TryFluentia does not host, distribute, or claim ownership of third-party video content.
7. AI Features and Limitations
TryFluentia uses artificial intelligence technologies, including large language models ("AI Models"), to provide learning assistance.
AI features may provide:
- Explanations
- Translations
- Vocabulary suggestions
- Grammar analysis
- Cultural insights
- Learning recommendations
You acknowledge that:
- AI-generated content may contain errors.
- AI responses may not always be complete or accurate.
- AI-generated explanations should be reviewed by users.
- AI output does not constitute professional educational advice.
TryFluentia does not guarantee the accuracy, completeness, or suitability of AI-generated content.
8. Third-Party AI Services
Some AI features require cloud-based AI processing.
TryFluentia uses third-party AI infrastructure providers, including:
- DeepInfra
Only the information necessary to generate AI responses is transmitted.
TryFluentia does not send:
- Raw audio recordings.
- Your complete learning database.
- Your complete learning history.
- Your local knowledge cards.
Third-party AI providers process information according to their own terms and privacy policies.
9. Subscription Plans
TryFluentia offers subscription-based services.
Starter Plan
The Starter plan provides free access to selected features.
Pro Plan
The Pro plan provides access to advanced AI-powered learning features.
Current price: $19.90 USD per month
Subscription prices may change in the future. Any price changes will apply after appropriate notice.
10. Payment Processing
Payments are processed through third-party payment provider: Creem.io
TryFluentia does not store complete payment card information.
By purchasing a subscription, you authorize the payment provider to process charges using your selected payment method.
11. Subscription Renewal and Cancellation
Pro subscriptions may automatically renew unless cancelled before the renewal date.
You may cancel your subscription at any time.
After cancellation:
- Your Pro access remains available until the end of the current billing period.
- Future subscription charges will stop.
- Previously paid subscription periods remain active until expiration.
12. Refund Policy
TryFluentia uses AI computing resources, including large language model inference and token-based processing costs, to provide AI-powered features.
Because AI resources may be consumed immediately after subscription activation:
- Subscription payments are generally non-refundable once a subscription period begins.
- We do not provide refunds for unused portions of a subscription period.
- Cancelling a subscription prevents future renewal but does not refund the current billing period.
By subscribing to TryFluentia Pro, you acknowledge and accept this refund policy.
13. Acceptable Use
You agree not to:
- Use TryFluentia for unlawful purposes.
- Violate intellectual property rights.
- Abuse AI services through excessive automated usage.
- Attempt unauthorized access to TryFluentia systems.
- Interfere with application operation.
- Reverse engineer or exploit the Application.
- Use TryFluentia to create unauthorized competing services.
We reserve the right to restrict or terminate access for violations of these Terms.
14. Intellectual Property Rights
TryFluentia and its related technology, including:
- Software
- User interface
- Design
- Branding
- Documentation
- Proprietary features
are owned by or licensed to us.
You retain ownership of your personal learning materials stored locally on your device.
15. Privacy
Your privacy is important to us.
Information about data collection and processing is described in our Privacy Policy.
By using TryFluentia, you acknowledge that you have reviewed our Privacy Policy.
16. Service Availability
We aim to provide reliable service but do not guarantee uninterrupted availability.
The Application may be unavailable due to:
- Maintenance.
- Software updates.
- Third-party service interruptions.
- Technical issues.
- Network problems.
We are not responsible for interruptions beyond our reasonable control.
17. Disclaimer of Warranties
TryFluentia is provided on an "AS IS" and "AS AVAILABLE" basis.
To the maximum extent permitted by law, we disclaim warranties including:
- Accuracy of AI-generated content.
- Continuous availability.
- Error-free operation.
- Fitness for a particular purpose.
18. Limitation of Liability
To the maximum extent permitted by law, TryFluentia is not liable for:
- Loss of local user data.
- Errors in AI-generated content.
- Issues caused by third-party platforms.
- Service interruptions.
- Indirect or consequential damages.
Our total liability shall not exceed the amount paid by you to TryFluentia during the twelve months preceding the event giving rise to the claim.
19. Termination
We may suspend or terminate your access to TryFluentia if:
- You violate these Terms.
- You misuse the Application.
- Required by law.
- Necessary to protect our users or services.
Upon termination:
- Your right to use TryFluentia ends.
- Subscription payments already made remain subject to the refund policy above.
20. Changes to These Terms
We may update these Terms from time to time due to:
- Product improvements.
- New features.
- Legal requirements.
- Changes in technology services.
Updated Terms will be published with a revised effective date.
